1. Legal Notice & Overview

These Terms of Service (“Terms”) govern the digital art services provided by Ilya Kazakov (“Artist”, “we”, “us”), registered in France as a Micro-entrepreneur and member of Maison des Artistes.

By creating an account, purchasing a subscription, or buying Points, you agree to these Terms. All services provided are digital, custom-created content.

2. Subscriptions & The Points System

Our services operate on a "Points" system. Users can obtain Points through a monthly subscription or by purchasing standalone Points.

  • The Basic plan is entirely free and does not include monthly Points.
  • Paid subscriptions grant a specific number of Points per billing cycle (e.g., the Pro tier grants 3 Points per month).

Users can redeem their Points to request custom digital artwork in the following categories:

  • Character Creation: A custom character based on your written description.
  • Personal Custom Request: A custom image based on a specific prompt.

Community Perks & Adventures:

  • Subscribers on specific tiers (e.g., Studio, Pro) gain exclusive access to our private Discord server.
  • Within Discord, eligible subscribers can participate in interactive "Adventures" (e.g., voting on narrative directions for comics/illustrations).
  • Participation in Adventures is a tier perk and does not consume your monthly Points.

Subscriptions renew automatically each month via Stripe. You may cancel your subscription at any time to prevent future billing.

3. Artistic Interpretation & Delivery

The Artist will create the artwork based on the prompt provided. The user is responsible for providing clear descriptions. However, art is inherently subjective. The final composition, style, and details are left to the Artist's professional discretion.

4. Refund Policy & EU Right of Withdrawal

Under EU consumer law, you have the right to cancel your purchase within 14 days without giving any reason.

  • Unused Points: If you have purchased a subscription or standalone Points and have not redeemed any Points from that specific transaction, you are eligible for a full refund within 14 days of the purchase date.
  • Redeemed Points: By redeeming a Point to request a custom artwork, you explicitly agree that the provision of the digital custom service begins immediately. Once a Point is spent, you expressly waive your 14-day right of withdrawal for that purchase, and no refunds will be issued.

5. No Revisions Policy

Due to the custom nature of the digital artwork, all services are provided "as-is". No changes, edits, or revisions will be made after the artwork is delivered. By spending a Point and submitting a request, you acknowledge and accept this policy.

6. Intellectual Property & Moral Rights

The Artist retains full ownership and copyright of all artwork created under French law.

  • License: You receive a non-exclusive, non-transferable license for strictly personal use.
  • Commercial Use: Prohibited unless explicitly agreed upon in a separate written license.
  • Moral Rights: The Artist retains the right to be credited. You may not remove the Artist's signature, apply AI-filters, significantly alter, or feed the artwork into generative AI models without written permission.

7. User Responsibilities

By using our services, users agree to the following rules:

  • Content Rules: Not to request unlawful, hateful, infringing, or explicit content. You must not submit copyrighted material claiming it as your own. The Artist reserves the right to refuse any request at their discretion (in which case, the spent Point will be refunded to your account balance so you can submit a different request).
  • Discord Community: Access to the private Discord server is a privilege linked to your active subscription. You must comply with Discord's Terms of Service and our community rules. The Artist reserves the right to kick or ban any user from the Discord server for toxic, hateful, or inappropriate behavior, without issuing a refund.

8. Delays and Limits of Liability

  • Unforeseen Delays: Sometimes life happens (illness, hardware failure, severe internet outages). If the Artist cannot deliver the artwork within the expected timeframe due to these circumstances out of their control, you will be notified, and delivery times will be extended accordingly.
  • Limitation of Liability: The Artist cannot be held financially responsible if you are dissatisfied with the subjective artistic style, or if you claim the artwork caused you indirect financial or personal losses. In any event, the Artist's maximum liability to you will never exceed the actual amount you paid for the specific Points used for that disputed request.

9. Data Protection

We process your personal data (name, email) solely to manage your account and fulfill orders, in compliance with the GDPR. For more details, please see our Privacy Policy.

10. Governing Law

These Terms shall be governed by the laws of France.
